This sounds more like the loophole that most manufacturers used (conveniently), in that the regs stated that the emissions controls could be temporarily reduced "to protect the engine"

This is different from the VW case where they ran different engine parameters when testing was detected.

This loophole is now closed for electrical products under the new Energy labelling regulation.

5. The supplier shall not place on the market products that have been designed so that a model's performance is automatically altered in test conditions with the objective of reaching a more favourable level for any of the parameters specified in the relevant delegated act or included in any of the documentation provided with the product.

Wonder when it will apply to cars?

They have fined them in the hope that it will stop other European countries doing the same.

This is a cynical attempt from the local government of Lower Saxony (a minority but overly influential shareholder) to minimise the fine, as said above.

This whole thing is a farce, and the toothless EU has done nothing about it

There has been a deafening silence from the EU and Downing Street/HMRC about this - presumably some cosy deals being worked on in the background.
